Eyewitness testimony is defined as the act of reporting from memory about an event previously observed. Eyewitness testimony is offered as evidence in a lawsuit. Specifically is any matter of fact that a party to a lawsuit offers to prove of disapprove an issue in the case. Evidence is also a system of rules and standards used to determine which facts may be admitted (U.S. Federal Rules).
The federal rules of evidence contain important competence requirements. To testify, a witness must swear that she or he will testify trustfully; possess personal knowledge of the subject matter of the testimony: have the physical and mental capacity to understand questions and communicate understandably. Competence is another way to say legally fit to testify in court. For example, a witness who was intoxicated or insane at the time the event occurred will be prevented from testifying, regardless of whether he or she was the only witness.
