Religion and the First Amendment

The first amendment in the United States Constitution not only includes freedom of press and speech but also insures two things about religion. It guarantees that “congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof” (Michael Shally- Jensen). This sates that congress can pass no law that says one religion is superior to the other. Also it protects an individual’s right to follow his or her belief of a particular religion (Michael Shally- Jensen). people have misunderstood the first amendment. Many people believe that student cannot pray in school or exercise their beliefs in a public setting. In Supreme Court case Zorach V. Clauson, Zorach wanted Jewish student to be excused from school on Yom Kippur. People argued that if they let the students be absent would show favor to a particular religious group (http://www.wisconline.com/objects/ViewObject.aspx?ID=CAS2201). The other said argued that by not letting them be absent the government is not letting the student practice their religion freely. The Supreme Court ruled in favor of letting the kids be absent. The majority vote stated that if the government did not allow the student to miss they would be “showing a callous indifference to religious groups” (http://www.wisconline.com/objects/ViewObject.aspx?ID=CAS2201).
