I have chosen as my topic for this case study the case of the 15 year old Gerald Gault. I think after reading numerous cases regarding Juveniles weather it be Kent vs. US, or Powell vs. Alabama, this in my opinion is the most important cases that has happened within the Juvenile Justice system.
The juvenile’s neighbor by the name of Mrs. Ora Cook said that she received in proper phone calls. Due to this happening, it caused big problems for the young juvenile by the name of Gerald Gault. probation was for stealing a wallet and being found delinquent. The sheriff of Gila County, AZ came to the residence of the minor child and arrested him and took him into custody. The first problem that the sheriff had caused here was that when making his apprehension he never let Gerald Gault’s parents know what was happening. The sheriff didn’t even leave a notice of any sort for the parents who were at work at the time of the arrest.
Gerald Gault’s Mother returned home from work on June 8, 1964 which was the morning that her son was arrested and realized that her son Gerald was not home. Mrs. Gault later that night found out that her son was at the Children’s detention home of the county but after arriving there she was not permitted to take her young fifteen year old son Gerald home.

The Gault family filed a motion for the release of their son which was called “Writ of Habeas Corpus”. The courts denial was affirmed by the Arizona Supreme Court. Upon hearing that their case was affirmed by the Arizona Supreme Court they didn’t give up and had an appeal with the United States Supreme Court scheduled.
