So, is it fair that because you make certain amount of money a year you should be penalized with an extra 3.8% tax increase? Not to mention that wealthy investors could withdraw their financial support from businesses. This is where the question arises if this law is constitutional or not. "The objections to health care reform are ultimately founded not on a genuine concern about preserving state prerogative, but on a libertarian opposition to compelling individuals to act for the collective good, no matter who imposes the obligation" (Cole 2011).
