Is Health Care Reform Constitutional

The question of whether the Health Care Reform is constitutional is very important topic in today's society. The answer to this question is different based on the individual who answers it and which way their political views lean. The debate between the two major political parties over health care reform revolves around how to pay for it and more importantly, whether it should be implemented at all by having citizens fined if they don't purchase insurance coverage. Also citizens earning more than $200,000 a year, or earning $250,000 or more as a couple, would be hit with a 3.8% surcharge on investment income to help pay for the bill. So, is it fair that because you make certain amount of money a year you should be penalized with an extra 3.8% tax increase?
