In order for an officer to do a legal search it has to have a warrant. In order for the officer to have a warrant he needs it issued by the judge. The only way the judge will issue the warrant if the officer presents probable cause. In the Terry v Ohio case the officer searched the men without a warrant because he had reasonable suspicion.
