INTRODUCTION:

The legal status of mercenaries and that of irregular forces refers to the place they hold in the eyes of international law. In order to understand their status in international humanitarian law, we must first understand the question of who a combatant is. Article 43 (2) of the 1977 Geneva protocol 1 states that:
Members of the armed forces of a Party to the conflict (other than medical personal and chaplains) are combatants, that is to say, they have a right to participate directly in the hostilities.

essay examines the legal status of a mercenary by firstly looking at the history of mercenaries, the problems in the definition, the status they now acquire, because of the enactment of certain conventions and the protections afforded to them under international humanitarian law.
