The case of Sauvé vs. Canada, a man named Richard Sauvé was serving a life sentence for first-degree murder. He challenged the Canada Elections Act, arguing that its ban on voting to all inmates serving sentences violated sections three and fifteen of the Canadian Charter of Rights and Freedoms.
The two Charter violations being addressed here are Democratic Rights, but most importantly Equality Rights. I feel that it violates his democratic rights because the right to vote is fundamental to a democratic society. I also feel that it violates his equality rights. I partially agree with the government’s right to put a limit on this Charter right. The amendment disqualifies only those prisoners who have committed serious crimes, not those who are serving time for summary offences. Furthermore, the prisoners who have lengthy sentences that are not of “life” status (life in prison) will have their voting rights restored to them upon release, so I do not find it unreasonable in this sense to temporarily disable their right to vote while they are serving their sentences.
However, I disagree with the Reasonable Limits Clause for those who are serving life sentences for indictable offences. These inmates will never be allowed outside of prison that is why this clause conflicts with their rights in an unjustifiable manner. There are always alternatives that can accommodate those with life sentences to vote. One of these alternatives could be those with no track record of violence or trouble with administration during their incarceration should be ...
