I. FACTS

After 12 years of marriage, Rita and Aaron are divorced. Under the divorce decree issued by the presiding judge of Family Court, Rita is granted custody of their two children. The decree requires that Aaron make child support payments to Rita. The decree also awards Aaron the dependency exemptions for the two children.
On his tax return subsequent to the divorce, Aaron claims his two children as dependents. In justification of his claim, he attaches a certified copy of the divorce decree to his Form 1040. Upon audit of the return, the Internal Revenue Service (IRS) disallows the dependency exemptions because the return does not include a Form 8332 signed by ...

According to these forms and publications, in general, a custodial parent who elects not to claim the dependency exemption should complete Form 8332, provide it to the non-custodial parent who wishes to claim the dependency exemption, thus authorizing the non-custodial parent to claim the exemption.
