Actually, there was evidence presented that Vanzetti was insane at the time of the crime. Commonwealth v. Sacco and Vanzetti, 255 Mass. 369, 151 N.E. 839 (1926). However, the Supreme Judicial Court of Massachusetts held that the Superior Court had no jurisdiction to grant a new trial because the motion was not timely. Both defendants were electrocuted in August, 1927
