The petitioner was Timothy Tyrone Foster and the respondent Bruce Chatman, Warden. The location for the case was at the Supreme Court of Floyd County in Georgia. Docket no. 14-8349. It was argued on November 2, 2015, and decided on May 23, 2016 (Oyez).


Foster was charged with killing an old woman named Queen Madge White in 1986. During the trial, the prosecution excluded four qualified black jurors. Based on the Batson v. The court ruled that there was enough evidence to show that there was deliberate discrimination in the jury selection of Foster’s trial, which is prohibited in Supreme Court’s Batson v. Kentucky.


The court stated that the defendant met the third step of a Batson challenge, which requires the presentation of evidence that the exclusion of jurors was deliberate and based on discrimination, which the state court erred in dismissing.

The Court further explained that the evidence presented indicated that the prosecution was not willing to let the excluded jurors serve, and the main reasons for excluding them were most likely pretextual (Oyez). The reasons provided for striking out the jurors were not sufficient, and the retrieved prosecution notes supported Foster’s argument that he suffered discrimination.
