The Balanced Budget Act of 1997 amended the Social Security Act by adding a new title XXI, the State Children's Health Program (CHIP). Title XXI provides funds to states to enable them to initiate and expand the provision of child health assistance to uninsured, low-income children in an effective and efficient manner. To be eligible for funds under this program, states must submit a state plan, which, must be approved by the Secretary. an enhanced federal matching rate for state CHIP programs is typically about 15 percentage points higher than Medicaid matching rate for that state. Every state administers its own CHIP program with broad guidance from CMS.

According to a study in the Journal Health Affairs, Reuter's reports, about five million uninsured U.S. children qualify for the children's Health Insurance Program or Medicaid but are not enrolled in either program. Families that earn too much to qualify for Medicaid but cannot afford private coverage can enroll their children in low-cost health insurance through CHIP. The report also found that 39% of the eligible uninsured children live in California, Florida or Texas. More than half of U.S. children live in these three states, according to the study. The study recommended that officials pursue policy changes and new initiatives to enroll more eligible children in CHIP and Medicaid.
