Audio or Electronic Surveillance is used to record a conversation that could give evidence about a crime. Examples are "wiretapping, bugging, pen registers, and trap-and trace devices" (p. 249).
Wires and listening devices are usually illegal. You can tap your own phone as long as you tell the person you're talking to that the conversation is being recorded. "No expectation of privacy exists when you're being recorded in squad cars, jail or prison cells, and interrogations rooms. Federal and state laws allow electronic surveillance, provided it is authorized by a federal or state judge and specified procedures are followed" (p. 250).
